New REACH restrictions for formaldehyde and other substances

What substances are subject to restrictions?

restriction-reach-formaldehydeOn April 9th 2018, the European Commission published the Official Gazette of the European Union, containing Regulations 2018/589 and 2018/588, bringing changes to Annex XVII of REACH by introcducing restrictions 69 and 71 respectively. Regulation 2018/589 was later ratified through a corrigendum published on April 23rd, concerning the date of entry into force of Restriction 69.
These newly introduced restrictions consist in:

  • Restriction 69: forbids the sale of methanol (CAS: 67-56-1; EC: 200-659-6) to the public in liquids for washing or thawing of windshields, in a concentration equal to or greater than 0,6 % in weight. Restriction 69 is valid starting from May 9th 2019.
  • Restriction 71: production, use and sale of 1-methyl-2-pyrrolidone (NMP) (CAS: 872-50-4 ; EC: 212-828-1) is forbidden, as substance or as component of mixtures in concentration equal to or greater than 0,3%, starting from May 9th 2020. Since there are exceptions to Restriction 71, we suggest the full reading of the actual text of Restriction 71 (Regulation 2018/588).

What news does Reg. 2018/675 introduce?

On May 4th 2018, the European Commission published the Official Gazette of the European Union containing Regulation 2018/675, bringing changes to restrictions 28, 29 and 30 listed in Annex XVII of REACH.
Restrictions 28, 29 and 30 concern substances classified as carcinogenic, mutagenic or toxic for reproduction (CMR) category 1A or 1B according to Annex VI of CLP. Annex VI of CLP will be amended by ATP10 in the classification of some substances as CMR 1A or 1B. In view of this upcoming change, Regulation 2018/675 updates the list of substances included in REACH Annex XVII.
This regulation comes into force on December 1st 2018, with the exception of the restriction on formaldehyde (CAS: 50-00-0; EC: 200-001-8; INDEX: 605-001-00-5), which is mandatory starting from May 24th 2018.
