On April 24th 2015, The Standing Committee of China's National People's Congress (NPC) voted to adopt amendment to the Food Safety Law. The newly revised food safety law will go into force on October 1, 2015.
Comparing to the 2009 version, it increased the articles from 104 to 154, 50 articles have been added. The new food safety law is called the toughest food safety law ever.
“It is the first change to the legislation since it took effect in 2009”, said Wei Huang, the administrative deputy of the Standing Committee of China's National People's Congress (NPC), “the modification of the food safety law is to fulfill three needs: to improve the regulatory system, to solve the current outstanding problems and to establish the most severe punishment system.”
The main modifications are as below.
Ban usage of highly toxic pesticides in specified crops
The state encourages and supports the usage of high efficiency, low toxicity and low residue pesticides, promote the research, development and application of alternatives of highly toxic pesticide, to accelerate the elimination of highly toxic pesticides.
Infant milk powder formula Registration and full production process quality control
Infant milk powder formula should be registered in the food and drug administration department under the State Council. Infant milk powder is not allowed to be produced by sub-package. The same company can not use the same formula to produce different brands of infant formula milk powder.
Infant formula manufacturer shall establish full production process quality control system and implement inspection of every batch to ensure food safety.
Online food trading is under regulation
To specify its food safety management responsibilities, the online food trading organizer should conduct real name registration of the food business operator. Consumers whose legitimate rights or interest is harmed by purchasing food through online third-party trading platform may claim compensation to the online food trading organizer or food producer.
Genetically modified foods should be significantly labeled in accordance with the provision. The violation of the lableling provision will lead to suspend or revoke of licence.
Health food labels should not claim treatment or prevention of disease
Health food labels should not claim treatment or prevention of disease, the label content should be true and consistent with the registration content, the label should specify the target people, not suitable people, the effective ingredients and its content, and include the statement "This product can not replace medicine".
