US: Draft Industry Guidance for Menu Labeling

The US Food and Drug Administration (FDA) announced the availability of a Draft Guidance for IndustryA Labeling Guide for Restaurants and Retail Establishments Selling Away-From-Home Foods—Part II (Menu Labeling Requirements in Accordance with 21 CFR 101.11)”.

This draft industry guidance comes following an extension of deadline for restaurants and retail food establishments to have nutrition labeling, including calorie counts, displayed on standard menus.

Background

Two months ago, FDA extended the compliance date for the Final Rule requiring disclosure of certain nutrition information for menus. Moreover, the FDA has announced to provide a draft guidance that, when finalized, should help restaurants and similar retail food establishments comply with the menu labeling requirements, including the requirements to provide calorie and other nutrition information for standard menu items, including food on display and self-service food.

Interested persons may submit either electronic comments regarding the draft guidance or submit written comments to the Division of Dockets Management by November 2, 2015.
